Chapter 7 bankruptcy is the preferable solution. Almost all people who file a Chapter 7 are able to discharge all their debts, keep all of their property, end all collection action and, in many cases, rebuild their credit fairly quickly after getting out of a Chapter 7 bankruptcy. Chapter 13, on the other hand, is a five year pay back plan which will involve the Bankruptcy Court having your employer take a substantial amount of money out of your pay check each month and send it in to the Bankruptcy Court for the next five years. The filing of a Chapter 7 bankruptcy will immediately stop creditor harassment, creditor lawsuits and garnishments, foreclosures and the seizing of your automobiles and other property.
It is not necessarily true that if your median income is higher than the median income for a family of your size that you will not qualify for Chapter 7 discharge bankruptcy. As long as you have not filed a Chapter 7 bankruptcy within the last eight years, you may qualify for a Chapter 7 bankruptcy even though your income is higher than the median income. You should have an experienced attorney because you will need to show that your reasonable monthly living expenses exceed your net take home pay.
If you are only making minimum monthly payments on your debts, it could take over 30 years to pay your credit debt back. In the end you will pay more than three times the current balance of the debt.
Understanding Attorney Fees: At the current time Mr. Kruse's charges $975 as a flat rate price for most simple uncomplicated bankruptcies which are about 95% of what we do. In addition to that there will be the $300 filing fee that we pay to the bankruptcy court when your case is filed. Some bankruptcies are more complicated and will cost a little extra. We can get started on a chapter 7 bankruptcy for as little as $200 down and payments on the balance.
